Issue Description: Matters concerning an exercise of any exclusive right of copyright with respect to a copyrighted work which, despite the absence of permission from or payment to the copyright owner, is not considered an infringement of that right under copyright law, based upon the application of four statutory criteria through which the use is evaluated in the context of the particular facts and circumstances in which it occurs.
